General.
By using the services provided through the managment of the Autrey.Org domain
("Autrey.Org"), you agree to be bound by the terms of this Acceptable
Use Policy ("Agreement"). Usage is defined as viewing any document
hosted on the www.autrey.org server,
including, but not limited to, HTML documents, scripts, or image files. Usage
is further defined as sending electronic mail ("e-mail") to any
Autrey.Org customer or account.
Commercial advertising is an accepted and welcome use of the Internet. However, there are appropriate and inappropriate places for Internet advertising. Autrey.Org reserves the right to charge a US $500.00 fee for each unsolicited commercial advertisement and/or message sent to an Autrey.Org customer or account. This fee is chargeable for each account the the advertisement or message is sent to. Note that unless a user specifically requests to be added to a mailing list, the electronic mail is unsolicited. Simply registering a product does not imply a request to be added to such a list.
Commercial advertisements are unwelcome on most e-mail mailing lists. Sending a message, especially an advertisement, is by itself spamming unless the individual has specifically requested information. The spamming of one recipient is considered UCE, or Unsolicited Commercial Email. UBE, or Unsolicited Bulk Email is when there is multiple recipients of UCE. UBE is especially erroneous and will be treated as such by Autrey.Org. E-mail is a person-to-person medium, not a broadcast medium.
Governing Law.
This Agreement shall be governed by and construed under the laws of the state
of Colorado, except as governed by Federal law. The application of the United
Nations Convention of Contracts for the International Sale of Goods is
expressly included.
Waiver.
Failure of any party to enforce any provision of this Agreement shall not
constitute or be construed as a waiver of such provision or of the right to
enforce such provision.
U.S. Government Restricted Rights.
Use, duplication or disclosure of Software and Documentation by the
Government is subject to restrictions set forth in subparagraphs (a) through
(d) of the Commercial Computer-Restricted Rights clause at FAR 52.227-19 when
applicable, or in subparagraph (c)(1)(ii) of the Rights in Technical Data and
Computer Software clause at DFARS 252.227-7013, or at 252.211-7015, and in
similar clauses in the NASA FAR Supplement.
